Legal Challenges and Allegations
Initially, prosecutors investigated Kim for potential insider trading, as he reportedly sold digital assets while serving on a committee that influenced cryptocurrency legislation. Eventually, the focus shifted, with Kim being charged for allegedly interfering with official duties rather than insider trading, which could result in a six-month prison sentence if he is convicted.
Legal complications persist for Kim, who is accused of providing inaccurate asset declarations to the National Assembly’s Ethics Committee regarding his cryptocurrency holdings. Although he was acquitted of these charges by the Seoul Southern District Court earlier this year—where the presiding judge, Jeong Woo-yong, stated there was a lack of evidence against him—the prosecution remains steadfast in their belief of having a strong case to appeal the decision.

A retrial is scheduled in the Appellate Division of the Southern District Court, commencing on July 17, where they will once again contest the legitimacy of Kim’s financial disclosures, which they allege omitted around 9.9 billion won (approximately $7.3 million) in cryptocurrency.
