The Virtual Assets Regulatory Authority (VARA) in Dubai has recently raised concerns regarding several firms associated with the cryptocurrency exchange KuCoin. In a notification dated March 5, VARA identified four entities—Phoenixfin Pte Ltd, MEK Global Limited, Peken Global Limited, and KuCoin Exchange EU GmbH—that are reportedly promoting services under the KuCoin name to residents of Dubai without appropriate licensing.

Regulatory Compliance and Risks

According to VARA, these companies may be engaging in activities related to virtual assets without the mandatory regulatory approval required in the emirate. The authority stressed that these businesses could be misrepresenting their legal standing in the region, which poses a significant risk to consumers. VARA has directed these entities to halt any unlicensed virtual asset operations within or from Dubai, highlighting that the exchange itself lacks the authorization to provide such services in the area.

Legal Framework and Consumer Protection

In line with local regulations, specifically Dubai Law No. (4) of 2022, it is imperative for any virtual asset service providers to secure regulatory consent from VARA prior to offering their services. The authority has expressed deep concern regarding the potential dangers that users may face when interacting with unlicensed platforms, pointing out that these interactions may lead to considerable financial losses or legal repercussions.

Advice for Residents

Residents are encouraged to confirm whether the firms they intend to engage with are registered with the regulatory body before proceeding with any transactions. VARA further clarified that no advertising or promotional activities for KuCoin have received approval, effectively barring the platform from marketing virtual asset products or services in Dubai.
