Advocating for Change in Mortgage Applications

In a significant push to alter the mortgage application process, Congressman Nancy Mace is advocating for a fresh approach to how cryptocurrency assets are considered by federal housing agencies. Mace took to Elon Musk’s platform, X, on July 19 to assert that the ownership of digital currencies should not hinder individuals from achieving the American dream of homeownership. She has revived her legislative effort known as the American Homeowner Crypto Modernization Act, aimed at modernizing mortgage underwriting criteria across various federal entities.

Legislative Efforts and Statements

“Possessing cryptocurrency should not disqualify a person from purchasing a home,” Mace declared in her post.

She expressed frustration over the current barriers facing hardworking Americans who have accumulated wealth through digital currencies, stating,

“Washington makes it increasingly difficult to reach this milestone. The existing system remains outdated and fails to recognize the real wealth that many have generated through cryptocurrency.”

Proposed Changes to Underwriting Policies

To address this issue, Mace’s proposed bill seeks to compel key federal housing organizations—including the U.S. Department of Housing and Urban Development (HUD), the U.S. Department of Agriculture (USDA), the Department of Veterans Affairs (VA), and the Federal Housing Finance Agency (FHFA)—to update their mortgage underwriting policies.

Reintroduced last year and presently under review by the House Committee on Financial Services and the House Committee on Veterans’ Affairs, the legislation would not simply allow any cryptocurrency balances to be self-reported by borrowers. Instead, it emphasizes the necessity of verified crypto ownership, requiring individuals to submit thorough documentation like transaction histories and proof of assets.

Current Challenges and Perspectives

Currently, conventional mortgage evaluations typically accept a range of assets, such as savings, stocks, or bonds. However, cryptocurrencies are often treated as a distinct asset class, which Mace contends presents an inequitable obstacle for investors in the crypto space.

“Those who have diligently worked to build their wealth should not face government impediments due to an outdated recognition of their financial resources,”

she commented.

Next Steps in the Legislative Process

As the bill proceeds through the legislative process, it must navigate committee discussions, secure votes in both the House and Senate, and ultimately receive the president’s signature before it can become law.
