The crux of the issue for Hyperliquid involves whether it can find a viable pathway to operate under U.S. regulations, as current parameters pose significant barriers. Presently, U.S. users are unable to access the trading interface of Hyperliquid, which has faced restrictions classifying its blockchain technology as illegal within the country.

Hyperliquid operates as a permissionless blockchain, meaning that while its underlying infrastructure and smart contracts operate independently, access through the main website remains restricted.

Terms of Use and Regulatory Environment

In its terms of use, the platform clearly identifies individuals located in the U.S. as “Restricted Persons,” thus preventing their engagement with the trading interface. Hyperliquid’s primary offering—perpetual futures—falls under a stringent regulatory environment established by the Commodity Futures Trading Commission (CFTC) in the U.S.

Advocacy and Growth

To tackle these challenges, Hyperliquid has established its Policy Center in Washington, launched in February 2026, under the leadership of crypto attorney Jake Chervinsky. The center aims to advocate for a defined and regulated pathway to grant American users access to decentralized financial markets.
