Concerns Over Cryptocurrency Market Accountability

Stuart Alderoty, the Chief Legal Officer of Ripple, has voiced urgent concerns regarding accountability and transparency in the rapidly evolving cryptocurrency market. He emphasized the necessity for clearer commitments from project developers and outlined the pressing need for investor protections as the U.S. Securities and Exchange Commission (SEC) contemplates new regulations governing crypto fundraising. Alderoty made these remarks on October 23, noting that many American investors have experienced significant financial losses from new cryptocurrency offerings due to issues such as fraud, abandoned projects, and security breaches.

Call for Accountability and Transparency

During his address on platform X, Alderoty, who also presides over the National Cryptocurrency Association (NCA), stated,

“Everyday Americans are facing substantial losses from new offerings, and this situation must improve. Investors have the right to understand the promises being made before they invest, along with knowing who will be held responsible for these promises.”

His call for project issuer accountability aligns with Ripple’s recent support for defined crypto fundraising regulations, which the company highlighted in a submission to the SEC on October 20.

Survey Findings on Investor Losses

Supporting this sentiment, a recent survey commissioned by the NCA, conducted by Harris Poll, revealed troubling statistics: half of the individuals who participated in recent crypto offerings reported losing money over the past year. These losses were primarily attributed to hacks, project failures, and fraudulent schemes. The survey included responses from 1,004 American crypto holders, 401 of whom had engaged with new offerings. Notably, survey results showed that only 48% of crypto holders expressed high confidence that available information would assist them in making informed investment decisions. In contrast, a significant majority—80%—recognized the value of standardized information across offerings.

Estimates from NCA suggest there are around 67 million crypto holders in the United States, indicating a wide-reaching impact of these investment risks. The association is pressing for regulations that would ensure buyers are adequately informed before making their purchases.

Proposed SEC Regulations

Under the SEC’s proposed Regulation Crypto Assets introduced on August 18, certain crypto fundraising activities could qualify for registration exemptions. For instance, one provision would allow issuers to raise up to $5 million over a four-year period, while another could permit up to $75 million annually. These issuers would still be required to provide necessary disclosures and comply with established fraud and market manipulation safeguards, although these regulations are still in the proposal stage.

Warnings About Scams

In a related warning issued on October 5, the SEC, alongside five partner organizations, cautioned the public about scammers impersonating trusted figures such as friends and financial advisers. The warning highlighted tactics including false profit claims and methods that initially grant limited access to withdrawals before cutting off investors entirely.

NCA Recommendations for Regulation

Furthermore, NCA’s recommendations for offering-specific regulations call for transparent disclosures accessible at the point of sale and timely updates following cybersecurity events. To bolster accountability, the NCA suggests establishing a designated U.S. address for legal correspondence pertaining to issuers and a public system to track the status of required filings.

Ripple’s Expansion in Trading Opportunities

Amid these developments, Ripple has also expanded opportunities for institutional traders by enabling access to over 100 traditional financial markets at all times, supporting a more integrated approach to trading.
