Urgent Notice from ASIC
The Australian Securities and Investments Commission (ASIC) has issued an urgent notice to cryptocurrency companies as the deadline for temporary regulatory relief looms. With the expiration date set for September 30, firms that have been operating under this temporary provision are now facing the critical decision of applying for an Australian Financial Services license (AFSL) to avoid potential penalties. Should these businesses fail to secure the necessary licenses by the deadline, they could incur fines of up to 10% of their annual revenue.
Applications and Compliance Requirements
More than 45 applications related to digital asset licenses have been recorded by ASIC since the update of its regulatory guidance in October 2025. The commission emphasized that all businesses needing an AFSL must either file for a new license or modify their existing one before the cutoff date. In addition, companies requiring market or clearing and settlement licenses are mandated to inform ASIC and arrange for preliminary meetings before proceeding with their applications.
Consequences of Non-Compliance
Starting October 1, any crypto businesses that have not complied with ASIC’s licensing requirements will be deemed to be operating outside the bounds of financial services law. This situation could lead them to face both civil and criminal repercussions. Previously, ASIC had extended the relief period from June 30 to September 30, broadening its scope to include businesses acting as authorized representatives of licensed operators or engaging in certain intermediary roles. At that time, around 30 applications had already been submitted.
Future Regulatory Framework
It’s important to note that this transitional relief mechanism is distinct from the upcoming Digital Asset Framework, which is scheduled for implementation on April 9, 2027. As the deadline approaches, the pressure is mounting on these businesses to align with regulatory requirements to continue operating legally in Australia.
