The defendants named in the case include Cash FX, its CEO Huascar Jose Lopez Castillo from Brazil, Ronald Pope, CEO of The Conversion Pros from Oregon, and Justin Halladay from Florida.

Details of the Complaint

Filed on a Friday in the US District Court for the Middle District of Florida, the CFTC’s complaint asserts that Cash FX operated a Ponzi-like scheme disguised as a multilevel marketing venture. It claims that the firm solicited and accepted over $950 million under the pretense of engaging in retail foreign currency trading within a commodity pool.

According to the CFTC, the defendants falsely represented that participant funds were managed by skilled traders utilizing proprietary algorithms and advanced artificial intelligence. They allegedly promised returns as high as 15% on a weekly basis. However, the agency argues that Cash FX conducted minimal forex trading, misappropriating most of the invested funds to pay fictitious trading profit claims while enriching the defendants with millions in unlawful earnings.

Misleading Practices and Financial Losses

The complaint further details how Cash FX provided participants with misleading accounting statements, contributing to losses that the CFTC estimates at over $406 million. David I. Miller, the CFTC’s Director of Enforcement, emphasized the agency’s commitment to safeguarding the public from fraudulent activities, stating that this case underscores their focus on tackling deception in the financial markets.

Regulatory Context

This lawsuit comes at a pivotal time as the CFTC is also advancing new regulatory measures aimed at overseeing cryptocurrency transactions, particularly following the Senate’s recent failure to progress the CLARITY Act, which sought to create a federal framework for cryptocurrency regulation. The recent submission for the new regulations is presently under review by the White House, signaling the CFTC’s ongoing efforts to enhance oversight in the rapidly evolving digital asset space.
