Advocacy for Users with Frozen Assets
Echo Base has taken significant steps to advocate for users whose assets have been frozen on the Bitmart platform by establishing a committee comprised of those affected. This initiative comes more than a month after Bitmart revealed plans to cease operations, prompting Echo Base to announce on September 2 that they were instrumental in forming an ad hoc committee aimed at addressing the growing concerns of users with inaccessible funds.
Legal Counsel and Asset Recovery
The firm, which specializes in the stabilization of digital asset companies, has also secured legal counsel to investigate possible avenues for asset recovery, including the option of an unfunded bankruptcy filing. This decision followed Bitmart’s lack of response to a funded bankruptcy restructuring proposal that Echo Base submitted on August 6, which included a provision of up to $10 million to assist in restructuring the company’s financial obligations.
Concerns Over Communication and User Funds
Echo Base’s statement highlights that this lack of communication from Bitmart has compelled them to take measures into their own hands. Additionally, the company has accused Bitmart of retaining user funds unlawfully. As documented, there was a formal demand submitted on August 8 by an Echo Base affiliate regarding Bitmart’s failure to process a withdrawal request that was made on July 24, approximately 31 hours prior to the announcement of the platform’s operational shutdown. This demand referenced over a dozen attempts to reach Bitmart without success.
Seeking Legal Assistance
Other users have levied similar accusations against Bitmart, prompting them to seek assistance from the Sonn Law Group for exploring possible claims for those who have $500,000 or more trapped in the exchange.
Bitmart’s Restructuring Plan
In a recent update on August 21, Bitmart revealed that it is working towards developing a restructuring plan instead of an outright shutdown. This proposed plan would involve a gradual resumption of certain operations, contingent on satisfactory legal, financial, operational, and regulatory evaluations. The company indicated that a detailed roadmap would be crafted in collaboration with advisors, with an update promised by September 9.
Ongoing Concerns and Urgency
However, despite this assurance, Bitmart hasn’t provided any further updates, raising suspicions among stakeholders regarding the status of the funds, with concerns that they may be missing or have been misappropriated. Roshan Dharia, CEO of Echo Base, emphasized the urgency of addressing these issues, noting that prolonged delays could lead to complications akin to administering a substantial fund over years. He reiterated that Echo Base has the requisite resources and expertise to conduct a proper and compliant wind-down of operations. The ongoing lack of response to their August 6 proposal significantly diminishes the feasibility of a constructive process for users awaiting access to their funds.
