New Regulations for Payment Stablecoins
In a significant move for the cryptocurrency sector, the Office of the Comptroller of the Currency (OCC) has finalized regulations pertaining to the issuance of payment stablecoins, alongside certain custody operations. This new regulatory framework aligns with the recently enacted GENIUS Act, which is slated to be implemented starting January 18, 2027.
Key Requirements for Stablecoin Issuers
The OCC’s new rule mandates that stablecoin issuers need to keep reserves that match the total value of their outstanding stablecoins. Additionally, firms must handle redemption requests within a two-day timeframe. This regulation will impact not only national banks and federal savings associations but also federal branches and their subsidiaries. Nonbank entities aiming for federal qualified issuer status will also fall under this regulation, as will state-qualified issuers subject to OCC’s oversight.
Intent Behind the Regulation
Comptroller of the Currency, Jonathan Gould, emphasized the intention behind this rule, stating, “We aim to provide a clear and practical framework that fosters innovation in payment stablecoins while ensuring robust standards for reserve backing and risk management.”
Prohibitions and Future Guidance
Notably, the final regulations do not include a previous proposal that would have presumed certain affiliations or interactions with third parties as violations of the law regarding yield bans. However, the OCC maintains its prohibition against issuers providing interest or yield simply for holding onto their stablecoins. The agency retains the ability to intervene against any attempts to circumvent this restriction.
In the coming weeks, the OCC is expected to announce when it will begin accepting applications and waiver requests from potential issuers. Further guidance regarding compliance with the Bank Secrecy Act, anti-money laundering regulations, and sanctions will be outlined in separate future rulings.
Conclusion
As the cryptocurrency market continues to evolve, these measures aim to instill confidence and clarity for both issuers and consumers dealing with payment stablecoins.
