Thailand’s Cryptocurrency Market Expansion

In a significant move aimed at expanding Thailand’s cryptocurrency market, the Securities and Exchange Commission (SEC) has completed its regulatory framework for exchange-traded funds (ETFs) based on cryptocurrencies. These new regulations will enable Bitcoin and Ether ETFs to officially be traded on the Stock Exchange of Thailand starting October 16, 2026.

Regulatory Framework and Restrictions

Initially, the approved ETFs will be restricted to Bitcoin and Ethereum, with a strict prohibition on the listing of related foreign crypto ETFs, including depositary receipts. Furthermore, retail investors, apart from ultra-high-net-worth individuals and institutions, will not be able to invest in overseas crypto ETFs through Thai brokers, ensuring a focus on domestic offerings.

Investor Protection and Fund Management

This initiative is designed to provide Thai investors with a regulated avenue to gain exposure to digital assets such as Bitcoin and Ether through the country’s main stock exchange. Attakrit Chimphlapibul, co-founder of Bitkub Group, noted the positive impact previous similar launches in the United States, like those of Spot Bitcoin and Spot Ethereum ETFs, had in boosting accessibility to the cryptocurrency market for both institutional and retail investors.

In a noteworthy shift, mutual funds and private funds will now be allowed to invest in local crypto ETFs, a change from the previous restriction that limited investment options solely to foreign ETFs. To ensure investor protection, brokers will not be allowed to extend margin loans to purchase ETF products, and large fund assets are required to be held by custodians that are regulated by the SEC. Additionally, potential investors must be adequately informed about the products and must acknowledge their understanding of the inherent risks involved before engaging in trades.

Investment Strategy and Market Impact

Crypto ETFs will be treated as passive investment vehicles with a strong focus on tracking the market price of the cryptocurrencies in which they invest. They must also maintain a consistent net exposure of at least 80% of their net asset value in a single cryptocurrency throughout each financial year. The SEC’s decision follows consultations conducted in April and May as well as review periods in August and September, during which the majority of feedback supported the proposed regulations.

The establishment of these rules thus marks a pivotal moment for the Thai cryptocurrency market, introducing structured opportunities for investors while aligning with international practices.
