Joint Statement from Blockchain Entities

In a recent joint statement, a coalition of six prominent blockchain entities has made a strong appeal to the U.S. Securities and Exchange Commission (SEC) to officially designate digital commodities as non-securities within its forthcoming regulatory guidelines. This request comes as the SEC wraps up its public consultation on potential regulations for cryptocurrencies, which concluded on October 20.

Signatories and Their Concerns

The signatories of the letter include well-known organizations such as Chainlink Labs and the Cardano Foundation, along with Hedera, Aptos Labs, Ava Labs, and the Stellar Development Foundation. They argue that the SEC’s existing recognition of digital commodities as a separate category is not adequately conveyed in the proposed Regulation Crypto Assets.

According to them, the lack of a clear definition could leave stakeholders—ranging from developers to investors—uncertain about their legal obligations under current securities laws.

Call for Clarity in Regulations

The letter emphasizes the need for the SEC to explicitly define digital commodities in its regulatory framework, as relying solely on interpretive guidance could hinder market participants by fostering ambiguity. Additionally, these organizations are calling for enhanced clarification regarding how securities regulations apply to secondary market transactions involving digital assets, as well as the implications for staking and other operations linked to decentralized networks.

Public Feedback and Future Directions

The SEC’s proposed framework, which was first unveiled in August, has attracted around 140 public comments over a two-month period. This feedback has encompassed diverse perspectives from industry figures and legal academics, highlighting differing opinions on potential exemptions for cryptocurrency offerings and a conditional safe harbor for certain types of tokens.

As discussions surrounding the regulation of digital assets continue, the coalition hopes their suggestions will pave the way for more definitive and supportive regulatory measures.
