Central Bank of Brazil Enhances Oversight of Digital Asset Transactions

In a move to enhance regulatory oversight of digital asset transactions, the Central Bank of Brazil has implemented new resolutions focused on self-custody wallets—wallets controlled entirely by users. These changes are motivated by concerns that such wallets limit transparency, posing challenges for monitoring and assessing risks within the financial system.

New Resolutions Announced

On a recent Wednesday, the central bank announced Resolutions 588 and 589, which revise existing regulations pertaining to anti-money laundering (AML) and combating the financing of terrorism (TF) for virtual asset services providers (VASPs). One of the key elements of Resolution 588 mandates that institutions licensed by the central bank report any transactions involving transfers of virtual assets amounting to $10,000 or more, specifically when these assets are held in self-custody wallets.

The bank emphasized that this requirement is essential for bolstering its supervision of user-controlled wallets, contrasting this with transactions where assets are managed by VASPs, thus providing a clearer picture of movement and ownership of digital assets.

Data-Sharing Framework and Compliance Timeline

Furthermore, the newly established data-sharing framework in Resolution 589 reinforces the overall regulatory environment by prohibiting transactions with unauthorized service providers. This measure establishes strict barriers to protect the Brazilian crypto ecosystem by ensuring that only licensed entities can engage in these financial activities.

As per the timeline set by these resolutions, all VASPs must secure their operational licenses by October 1, 2026, marking the deadline for compliance. The intensified scrutiny may already be reshaping the landscape of Brazil’s cryptocurrency sector, where, to date, only five providers have sought official authorization, potentially signaling a wave of consolidation within the market.

This regulatory shift comes at a time when interest in cryptocurrency assets has encountered a notable downturn, with significant drops in investment figures reported by the Central Bank of Brazil in recent months.
