FCA Intensifies Efforts Against Unlawful Cryptocurrency Trading

The Financial Conduct Authority (FCA) is intensifying its efforts to combat unlawful peer-to-peer cryptocurrency trading in London. Collaborating with HM Revenue & Customs (HMRC) and the Metropolitan Police Service, the FCA targeted three locations believed to be engaging in these illicit trading activities. As part of this operation, cease and desist letters were issued to each site, demanding that they cease operations linked to unauthorized crypto trading activities immediately.

Understanding Peer-to-Peer Trading Risks

In peer-to-peer (P2P) trading, individuals directly buy and sell cryptocurrencies without the intermediation of a registered business, which, in the UK, necessitates appropriate registration. At present, there are no P2P crypto trading operations that hold FCA registration in the UK. Unregistered traders pose a significant risk, as their operations can facilitate money laundering and other criminal actions due to their evasion of the FCA’s oversight.

“Through collaboration with our partners, we will persist in identifying and dismantling illegal crypto operations. Those involved in unregistered peer-to-peer trading should understand that they are under our scrutiny,” said Steve Smart, the FCA’s executive director of enforcement and market oversight.

Challenges in Law Enforcement

Detective Sergeant Sathish Alalasundaram from the Metropolitan Police emphasized the challenges faced by law enforcement in addressing crimes relating to digital currencies. He noted,

“The fast-moving nature of cryptocurrency transactions and their cross-border capabilities present consistent hurdles for investigators. As criminal tactics become more sophisticated, the police adapt our investigative strategies to ensure accountability for those violating the law.”

Ongoing Initiatives and Consumer Protection

This recent initiative builds on a prior operation conducted in April targeting similar illegal activities, with ongoing investigations utilizing evidence collected during that earlier crackdown. The FCA has previously taken notable actions against illegal crypto activities, including prosecuting individuals suspected of running unauthorized exchanges.

The FCA remains dedicated to collaborating with both domestic and international partners in the fight against financial crime to safeguard consumers. Individuals can verify the registration status of cryptocurrency firms through the FCA’s official database.
