AUSTRAC’s Regulatory Crackdown on High-Risk Payment Businesses

In a significant regulatory crackdown, Australia’s financial intelligence agency, AUSTRAC, has taken action against various high-risk payment businesses, leading to the cancellation, suspension, or non-renewal of 45 registrations related to cryptocurrency and remittance services over the span of one year. This initiative is part of a broader effort to enhance oversight and mitigate the risks associated with financial activities that could facilitate money laundering or terrorism financing.

Targeted Actions and Operational Requirements

The Australian Transaction Reports and Analysis Centre announced on Monday that the targeted actions encompassed companies deemed inactive, unable to meet operational requirements, or showing signs of insolvency. Furthermore, AUSTRAC identified several providers that failed to report critical changes in their operational status or had incorrect registrations.

CEO’s Statement and Legal Implications

AUSTRAC’s CEO, Brendan Thomas, emphasized the seriousness of these measures, stating that businesses whose registrations were revoked can no longer legally operate within Australia.

Notably, he mentioned that authorities have also engaged with law enforcement agencies, both domestically and internationally, to address concerns related to individuals connected to these businesses.

Notable Operations and Fraud Prevention

Among the notable operations highlighted was the cancellation of BA Digital Ventures, which operated under the name GetCoins. This registration, revoked in June, was a direct response to numerous customer complaints and allegations that GetCoins had been misused in organized cryptocurrency investment scams. The decision to disband GetCoins was a collaborative effort with the National Anti-Scam Centre and was aimed at curbing fraudulent activities.

Ongoing Investigations and Commitment to Integrity

While AUSTRAC refrained from disclosing the identities of all 45 businesses involved or providing a precise categorization of crypto versus remittance services, they did acknowledge recent actions involving firms such as GetCoins, Cryptolink, Self Custody, Jam Xchange, and Coinsec Australia. Additionally, AUSTRAC has initiated an investigation into Western Union and suspended the operations of Cryptolink’s crypto ATM network.

This development reflects AUSTRAC’s commitment to maintaining the integrity of Australia’s financial sector and its proactive stance against criminal activities related to cryptocurrency and digital transactions.
